Tiraspol, 27 April. /Novosti Pridnestrovya/. Pridnestrovian lawmakers have adopted on first reading amendments to the Code of Administrative Offences submitted by the president.
In particular, it is «proposed to specify elements of the traffic offences whose limitation period should be extended to one year.» This refers to driving under influence, transferring control of the vehicle to a drunken person; failure to comply with a legitimate demand to pass a medical examination for alcohol intoxication, traffic violations causing damages to vehicles or other property or weak and moderate injuries to the victim, as well as other traffic offences.
The substantiation of the draft law underscores that proceedings in some cases involving persons who were intoxicated at the time of the offence may take longer than the established two months' period as it provides for the application of special measures aimed at ensuring a timely and fair hearing of an administrative offence.
«It should also be noted that decisions imposing administrative charges made by competent authorities and courts on violations in the sphere of road traffic are very often appealed by both victims and offenders. And the sides' arguments are often based on expert findings, including technical, and examinations determining injury degrees and intoxication degrees, which takes an incredible amount of time. In connection with the above circumstances, because of the expiration of limitation periods, it is often impossible to bring the offender to account and restore citizens' violated rights," reads the explanatory note.
During debates MPs highlighted the significance of these innovations. The minister of justice, Olga Zvarych, pointed out that when drafting this bill, opinions voiced at the Supreme Council's plenum were taken into consideration.
The draft law has been approved by a majority vote.
