Parliamentary committee proposes to override president's veto on law 'On international agreements'

Tiraspol, 19 April. /Novosti Pridnestrovya/. The committee on legislation, law enforcement bodies, security, peacekeeping activities, protection of citizens' rights and freedoms have reconsidered the laws «On international agreements of the Pridnestrovian Moldavian Republic» and «On introduction of amendments and supplements to the law 'On regulations of the Supreme Council of the PMR'', which were previously vetoed by the president.

It is recalled that the draft law submitted by the president was conceptually modified while passing its second reading when the legislation committee proposed to make an amendment stipulating that the Supreme Council would retain the right to make decisions recognising international agreements as framework norms of law.

In the course of a plenary session the republic's prosecutor proposed to draw a distinction between the powers of the Supreme Council and those of the president and the government, with the result that the parliament would be empowered to recognise international agreements as framework norms of law in the event it was necessary to amend the legislation, or there were contradictions between international agreements and the country's national legislation. Alexander Deli explained his position by the fact that very often international agreements are signed between Pridnestrovian and foreign ministries. However, the prosecutor's amendment was rejected.

The president, in turn, vetoed the laws adopted by the Supreme Council. Justifying his decision, the president underscored that the legislative settlement of the issue on distribution of powers between public authorities regarding the recognition of an international agreements as a framework norm of law must be based on the concept of power distribution applied to other ways of concluding agreements in compliance with the norms of the PMR's constitution.

«The lack of a unified approach to this issue, which has become manifest by amending Article 21 of the law on international agreements, may virtually lead to the unbalancing of constitutional powers between the PMR's public authorities in terms of signing international agreements, enhancing the Supreme Council's role… Such an approach levels out the head of sate's powers in the sphere of foreign policy, as well as the government's powers to conclude international agreements of the PMR within its jurisdiction," the president believes.

However, the relevant committee has decided to recommend the Supreme Council's session to override the president's veto.
