An expanded meeting of the Collegium of the PMR Prosecutor's Office is devoted to summing up the results of 2019. The PMR President, heads of state authorities and administrations, prosecutors of cities and regions, and operative workers of the republic’s prosecutor’s office were invited to the discussion.
Chairman of the Collegium of PMR Prosecutor Alexander Troyanovsky voiced a report on the results of the activities of prosecution authorities in the field of supervision of the implementation of laws by bodies investigating crimes and operational-search activities, as well as the administrations of prisons. The speaker drew attention to the fact that in the reporting year the lowest crime rate in the last 17 years was recorded. 11% fewer crimes than in 2018 – 3515 were registered. The detection rate of grave and especially grave crimes was fixed at 88%, Alexander Troyanovsky said, noting that prosecutors have questions about the validity of registering some of them. As an example, statistics related to the illegal sale of drugs was given. 264 especially serious crimes of this category were registered in 2019. At the same time, the PMR Prosecutor and the Tiraspol Prosecutor canceled 52 illegal decisions to initiate criminal cases (20% of the number of registered cases), that is, the percentage of disclosure does not fully correspond to reality, said Alexander Troyanovsky. According to him, in the reporting period, 2241 illegal decisions of interrogators were canceled by prosecutors of cities and regions. Most of them are related to the refusal to initiate criminal proceedings.
Another aspect that the speaker paid attention to is the problem of red tape in the work of investigators and interrogators when considering cases, including criminal ones. A third of the complaints received in this regard by the prosecution authorities are considered substantiated. According to Alexander Troyanovsky, the last few years there has been a tendency to increase their number: 735 were received in 2014, in 2018 - 1100, in 2019 - 1368 appeals related to the work of the investigation and inquiry. As a positive point, the speaker noted the growing confidence in the prosecution authorities among the population.
Alexander Troyanovsky spoke about the prevailing opinion about, perhaps, the overestimation of the requirements of prosecutors when they assess the quality of cases sent to the court. In his opinion, statistics show that prosecutors are consistent in their work and apply uniform approaches, norms and principles of assessment. As a confirmation, the speaker noted that in 2019 the prosecutor's office studied 1562 criminal cases. 229 of them were sent for additional investigation. Exactly the same - 15% - the indicator was recorded in previous years.
Alexander Troyanovsky spoke about inspections in penitentiary institutions (there were seven last year) and the violations identified. He especially focused on the condition of temporary detention facilities, noting that it was improved. As a positive aspect, bringing into proper form and equipping the investigation rooms with computer equipment was noted. The PMR Prosecutor talked about cooperation with various bodies of state power and administration, noting that in the reporting year, the President’s order was clearly executed to conduct at least quarterly joint extended meetings. It was also about the participation and prosecutors in lawmaking.
A voluminous report on the activities of prosecution bodies to oversee the implementation of existing legislation was presented by Deputy Prosecutor of the PMR Valery Starodub. He spoke about planned inspections conducted in ministries and departments, local authorities, in the presidential executive office and the PMR Government. He focused on violations of labor legislation, noting that an increase in the number of recorded facts does not indicate an increase in the number of offenses, but an increased quality of work of employees of regulatory bodies. Among the topics highlighted by the speaker are cases of unlawful collection of fees from the parents of pupils and pupils of educational institutions, as well as the problem faced by citizens caring for children with disabilities until they reach the age of 18. The fact is that in order to take into account these years in the work experience, it is necessary to inform the relevant social service bodies about the implementation of this activity. As practice has shown, out of ignorance, most citizens of this category did not fulfill this requirement. To resolve the situation, it is necessary to make adjustments to legal norms, it was noted during the meeting. In this regard, the President was interested in how many legislative initiatives came from the prosecutor’s office last year with such a right. In 2019, there were 11 (for comparison: in 2018, only 4). The President called this progress important, stressing that the prosecutor's office is obliged to participate in improving the legislative framework, since it is the prosecutor’s bodies that citizens most often turn to for all facts related to gaps in legislation or the ambiguity of understanding of existing norms.
Olga Tkachenko told the participants of the Collegium on ensuring the participation of the prosecutor in criminal proceedings, and the PMR Military Prosecutor Vadim Dengovsky reported on the main results of the activities of the PMR Military Prosecutor's Office.
Having listened to the speakers, questions, answers, opinions and comments of other participants in the meeting, the PMR President noted that such reporting meetings and discussions are needed to achieve the most effective and efficient work of departments. Reasonable criticism he called necessary. The President noted the increased burden on prosecution authorities. Vadim Krasnoselsky drew particular attention to the interaction of officials with citizens of the republic. The President considers it necessary to carry out verification activities for personal consideration by officials of applications received against them. Vadim Krasnoselsky considers it appropriate involvement of specialized experts in the work, but the complete detachment of the addressee official from the complaints and appeals process is unacceptable.
Among the presidential instructions and recommendations voiced at the meeting of the Collegium of PMR Prosecutor's Office are the revision of the list of drugs banned for import into Pridnestrovie, the participation of the prosecutor's office in preparing an amnesty dedicated to the 75th anniversary of the Victory and the 30th anniversary of the PMR, and the development of a unified republican plan of measures aimed at the fight against corruption, tight control over the targeted spending of budget funds. In the course of the meeting, an instruction was addressed to the PMR Government: to prepare a legal act prohibiting the export of Pridnestrovian forest. The facts of wood smuggling should be under the most severe control of the relevant structures, including prosecution authorities, the President aimed.
Concluding the meeting, Vadim Krasnoselsky expressed gratitude to the employees of the prosecutor’s office for the work, noting that its main assessment was the growing confidence of citizens.
