Tiraspol, 13 April. /Novosti Pridnestrovya/. Lawmakers have passed a law on first reading increasing the prosecutor's powers in the sphere of the supervision of law observance by public authorities. The draft law particularly introduces a norm providing for the supervision over the president’s observance of legislative rules and the constitution.
The proposed version also supplements the current law «On prosecutor's office» with a norm stipulating that «the subject of the supervision is the observance of the rights and freedoms of a human and a citizen», including «the President and the Government of the PMR».
Both Supreme Council deputies and the prosecutor's office have given a positive evaluation of the bill.
At the same time, the minister of justice, Olga Zvarych, regards this norm as contradicting the constitution. According to her, empowering the prosecutor's office to oversee the president's activities disrupts the system of checks and balances.
«The prosecutor's office was established as a body which enables the president to implement his duties as head of state. To introduce the prosecutor's supervision over the president is illogic and contradicts the president's status," said the minister.
Olga Zvarych noted that Russia's legislation does not have a norm empowering the prosecutor general to oversee the president's activities, either.
The president's plenipotentiary to the Supreme Council, Vladimir Bodnar, also considers this bill dangerous. According to him, this places the prosecutor in a special position, which also violates the constitution.
«If the prosecutor has made a mistake, who will supervise him? Who will check him?» asks Bodnar.
Lawmakers have decided to continue to work on the bill and elaborate it for the second reading.
