Procedure of issuing entrepreneurial licences should be kept intact

Such an opinion was expressed by the Supreme Council's relevant committee about the government's draft law providing for the transition from the declarative to administrative licensing procedure for some types of entrepreneurial activities

Tiraspol, 28 March. /Novosti Pridnestrovya/. The Supreme Council's committee on entrepreneurship recommends rejecting the government's draft law «On amending and supplementing the Law of the PMR 'On licensing of certain activities'". Such a decision was adopted at today's committee meeting.

According to the head of the registration and notary service under the Ministry of Justice, Stanislav Grigoritsa, the daft law aims to change a licensing procedure from declarative to administrative. To do this, it is proposed to supplement the list of documents necessary for obtaining a licence with a certificate issued by a competent authority establishing licensing requirements for the spheres of activities within its jurisdiction.

According to Stanislav Grigoritsa, at present in most cases an authority issuing an entrepreneurial license and a body supervising the conduct of business in this or that sphere are different organisations. Therefore, a licence-issuing authority cannot check a company's compliance with all requirements as this is beyond its jurisdiction. A check is run only after a company has started its work.

«Now licensing requirements are checked, but they are checked post factum, after a licence has been issued. The law aims at checks being run before issuing licences," noted the head of the service.

However, MPs highlighted the fact that an entrepreneur will have to obtain documents for a licence from two authorities instead of one, whereas in Russia an authority issuing licences also supervises the sphere of licensed activities.

According to lawmakers, this issue should be settled in the same way in the future, but as for now the committee recommends the existing procedure of post factum checks should be kept.
